Terms of Service
Last updated 25 October 2026
These terms apply to RushTill, provided by Ablecare Solutions Pty Ltd (ABN 92 669 634 502) (“we”, “us”), and to the business that subscribes to it (“you”). By signing up for or using RushTill you agree to these terms. If you agree on behalf of a business, you confirm you are authorised to do so.
1. The service
RushTill is a cloud point-of-sale system. Depending on your plan it includes the Counter, menu management, receipt and kitchen printing, a kitchen display, reports and a business web page. Features are described on our website and may change as we improve the service. We will not remove a core feature of your plan during a paid period without reasonable notice.
2. Accounts and access
- You are responsible for the staff accounts you create, for keeping sign-in details secure, and for what is done through your accounts.
- Tell us promptly if you suspect unauthorised access. We may suspend an account to protect you or the service.
- Owners and managers can change prices, menus and staff access; give these roles only to people you trust.
3. Fees and billing
- Subscriptions are charged per location, monthly or annually in advance, at the prices shown on our website or agreed with you in writing. Prices are in Australian dollars and exclude GST unless stated.
- Add-ons (such as extra kitchen screens or printers) and any setup services are charged as agreed.
- We may change prices with at least 30 days' notice. Changes apply from your next billing period, and you may cancel before then.
- If payment is overdue we may, after notice, suspend the service until it is paid.
4. Cancellation and refunds
You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you can keep using RushTill until then. Fees already paid are not refunded for partial periods, except where required by the Australian Consumer Law or agreed in writing. Before your account closes you can ask us for an export of your data.
5. Your responsibilities
- Your products and prices. You are responsible for your menu, prices, product descriptions, and allergen, dietary and halal or other claims, and for complying with food safety, labelling and consumer laws.
- Tax. You are responsible for your GST settings, receipts and tax obligations. RushTill helps calculate and print GST, but you must check the settings are right for your business.
- Payments. Card payments are processed by your own payment provider or EFTPOS terminal under your agreement with them. We are not a payment provider and do not hold your funds.
- Equipment and internet. You provide and maintain your devices, printers, routers and internet connection. RushTill needs a working internet connection to record sales and print.
- Your customers' information. If you record personal information about your customers, you are responsible for having a lawful basis to collect it and for your own privacy obligations.
6. Acceptable use
You must not use RushTill for anything unlawful, to infringe others' rights, to upload harmful code, to attempt to access other businesses' data, or to overload or interfere with the service. We may suspend or remove content or accounts that breach this clause.
7. Your data
You own the business data you put into RushTill. You give us permission to host, copy and process it only as needed to provide, secure and support the service. We handle personal information in line with our Privacy Policy. Each business's data is kept separate from other businesses'.
8. Your web page and branding
If your plan includes a business web page, you are responsible for the content, logos and photos you supply, and you confirm you have the right to use them. We may display a “Powered by RushTill” link on it.
9. Availability and changes
We work to keep RushTill available and reliable, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, and we will try to schedule it outside typical trading hours. Third party services we rely on (such as hosting, sign-in, internet and payment providers) may occasionally be unavailable.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law that cannot lawfully be excluded or limited.
11. Limitation of liability
To the extent permitted by law, and subject to clause 10:
- where we are allowed to limit our liability for failing to comply with a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again;
- we are not liable for indirect or consequential loss, including lost profits, lost sales or lost data, arising from your use of RushTill; and
- our total liability to you in any 12-month period is limited to the fees you paid us in that period.
12. Suspension and termination
We may suspend or end your access if you materially breach these terms and do not fix the breach within a reasonable time after notice, or immediately where needed to prevent harm, fraud or a breach of law. If we end the service for our own convenience, we will give you at least 30 days' notice and refund any fees paid for the unused period.
13. Changes to these terms
We may update these terms. If a change materially affects you, we will give you reasonable notice before it applies. Continuing to use RushTill after a change takes effect means you accept it.
14. General
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction. If any part of these terms is unenforceable, the rest continues to apply.
